Terms of Service

Last Updated: 5/28/2026

1. Acceptance of Terms

By accessing or using the MedBadge platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you must not access or use the Service.

2. Strict Prohibition on Protected Health Information (PHI)

WARNING: DO NOT UPLOAD PATIENT DATA

MedBadge is a professional portfolio and peer-recognition platform. It is NOT a platform for storing, transmitting, or processing Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA) or the Confidentiality of Medical Information Act (CMIA).

You expressly agree that you will not upload, post, or transmit any documents, reviews, or text that contain identifiable patient information. You assume absolute, total liability for any HIPAA or CMIA violations resulting from your misuse of this platform.

3. Limitation of Liability regarding Credential Verification

MedBadge provides a software interface to aggregate and display professional credentials, licenses, and peer endorsements. MedBadge is NOT a Primary Source Verification (PSV) entity.

Healthcare facilities, hospitals, and agencies utilizing MedBadge data remain solely responsible for performing their own independent Primary Source Verification in accordance with The Joint Commission (TJC), DNV, or state board requirements. MedBadge disclaims any and all liability for negligent hiring, credentialing lapses, or malpractice claims arising from the reliance on our gamified UI, OCR processing, or automated API verifications.

4. Acceptable Use Policy (AUP)

You agree not to use the Service to:

  • Upload fraudulent, forged, or expired medical credentials or NPI numbers.
  • Manipulate the gamified rating system by leaving fraudulent peer reviews for yourself or others (e.g., "Review Bombing").
  • Attempt to reverse engineer the Zero-Trust REST API or bypass the Custom Claims access control.
  • Scrape, mine, or harvest data from the MedBadge directory without express Enterprise B2B authorization.

5. Indemnification

You agree to defend, indemnify, and hold harmless MedBadge, its founders, affiliates, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service, including but not limited to your uploading of PHI or forged credentials.

6. Subscription and Billing

Certain features of MedBadge (e.g., MedBadge Pro, Facility Dashboards) are billed on a subscription basis via Stripe. You will be billed in advance on a recurring basis. MedBadge reserves the right to suspend your access if payment fails.
